Probate Fees and Expenses in Missouri

In Missouri, Probate Fees consist of several components.  The most common are attorneys’ fees, which are generally governed by Statute.  Additionally there are court costs and publication fees that must be paid, and depending on the situation, Bond Premiums and fees charged by the Personal Representative, or Executor.  Fees are generally a function of the size of the estate.

The Missouri Minimum fee schedule for attorneys sets forth the presumed fee that will be paid.  The Personal Representative’s fee is generally identical to that paid to the Attorney.  The Attorney may be willing to negotiate the fee, or agree to be paid hourly.  Sometimes this works out well, sometimes it doesn’t.  You should discuss this with your Attorney if this is of interest to you.

In the event that there are disputed matters, fighting heirs, etc., then the fees can be much higher, and are difficult if impossible to predict.

Additionally, fees and expenses may be incurred in liquidating assets, such as real estate commissions.
